{"id":28960,"date":"2025-07-23T09:10:23","date_gmt":"2025-07-23T07:10:23","guid":{"rendered":"https:\/\/addwill.eu\/?p=28960"},"modified":"2025-07-23T09:10:23","modified_gmt":"2025-07-23T07:10:23","slug":"el-tribunal-suprem-reafirma-el-limit-legal-en-la-indemnitzacio-per-acomiadament-improcedent","status":"publish","type":"post","link":"https:\/\/addwill.eu\/ca\/el-tribunal-suprem-reafirma-el-limit-legal-en-la-indemnitzacio-per-acomiadament-improcedent\/","title":{"rendered":"El Tribunal Suprem reafirma el l\u00edmit legal en la indemnitzaci\u00f3 per acomiadament improcedent"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">El Ple de la Sala Social del Tribunal Suprem ha dictat una <strong>sent\u00e8ncia clau<\/strong> que aclareix un punt rellevant en l\u2019\u00e0mbit laboral: <u>la indemnitzaci\u00f3 per acomiadament improcedent fixada a l\u2019article 56.1 de l\u2019Estatut dels Treballadors no es pot incrementar en seu judicial<\/u>, encara que hi hagi circumst\u00e0ncies particulars en el cas concret.<\/p>\n<p style=\"text-align: justify;\">Aquesta resoluci\u00f3 s\u2019emmarca en el debat sobre l\u2019aplicaci\u00f3 del dret a una \u201cindemnitzaci\u00f3 adequada\u201d, recollit tant en el Conveni 158 de l\u2019OIT com en l\u2019article 24 de la Carta Social Europea revisada. En aquest sentit, el Suprem ha estat clar en assenyalar que aquests textos <strong>no tenen efecte directe ni for\u00e7a vinculant<\/strong> en l\u2019ordenament jur\u00eddic espanyol. Per tant, la seva aplicaci\u00f3 efectiva requereix una <strong>transposici\u00f3 o un desenvolupament legislatiu espec\u00edfic<\/strong>.<\/p>\n<p style=\"text-align: justify;\">A m\u00e9s, el Tribunal aclareix que les decisions emeses pel Comit\u00e8 Europeu de Drets Socials (CEDS), l\u2019\u00f2rgan encarregat de supervisar l\u2019aplicaci\u00f3 de la Carta Social Europea, <strong>no s\u00f3n executives ni obliguen els tribunals nacionals<\/strong>. Aix\u00f2 les diferencia de les resolucions del Tribunal Europeu de Drets Humans (TEDH) o del Tribunal de Just\u00edcia de la Uni\u00f3 Europea (TJUE), que s\u00ed que tenen efecte vinculant.<\/p>\n<p style=\"text-align: justify;\">En definitiva, aquesta sent\u00e8ncia refor\u00e7a la idea que la <strong>indemnitzaci\u00f3 taxada vigent<\/strong> garanteix <strong>seguretat jur\u00eddica i uniformitat<\/strong> en els procediments per acomiadament improcedent.<\/p>\n<p style=\"text-align: justify;\">Tens dubtes sobre com pot afectar aquesta interpretaci\u00f3 a la teva empresa o a les teves relacions laborals?
