This article highlights the most important changes in legal procedures concerning people with disabilities and how these have evolved.
In 2021, Spain passed Law 8/2021 on June 2, reforming civil and procedural law to better support people with disabilities in exercising their legal rights.
This new law introduced significant improvements, prioritizing the will and preferences of people with disabilities and representing a much more respectful approach compared to earlier legislation.
Before this reform, legal proceedings often declared people with disabilities as legally incapacitated and appointed a tutor—usually a family member—to make decisions on their behalf. This process was seen as overly intrusive and less respectful of personal autonomy.
With Law 8/2021, the focus shifted to implementing specific measures tailored to the needs of each person with a disability. These measures aim to respect individual circumstances and provide the right level of support, making the procedure more considerate and fairer.
To initiate this process, applicants must submit detailed medical and social reports to determine the areas where support is needed (e.g., social, healthcare, financial, or property-related) and specify the type of assistance required.
Steps in the legal process
The process involves three main stages:
- Filing the request
At this stage, all necessary medical and social documentation must be submitted, along with a description of the requested support measures. - Evidence collection
The court carries out two evaluations: an interview between the judge and the individual with a disability, and a forensic medical assessment. These are typically conducted simultaneously. - Trial and final Rrecommendations
During the trial, immediate family members are required to testify. The petitioner’s lawyer and the Public Prosecutor present their recommendations to the court. The Public Prosecutor’s role is to ensure that the proposed measures fully safeguard the rights and interests of the person with disabilities.
Final ruling
The process concludes with the court issuing a judgment that establishes the specific support measures necessary to enable the person with disabilities to exercise their rights effectively and respectfully.
