In April 2024, the Spanish Government announced its intention to eliminate the granting of the so-called ‘Golden Visa’, which was finally approved on January 2nd. The entry into force of this measure will take place 3 months after its publication in the Official State Gazette, that is, on April 3rd, 2025.
Likewise, the law that approved this measure has approved a transitional regime for those who have invested and applied for a visa by the date on which the aforementioned law is modified, i.e. April 3rd, 2025. The ‘delayed’ entry into force of this cessation together with the transitional regime makes it relevant to analyze the cases that could be affected.
This measure is particularly relevant for all those non-EU citizens who are considering moving their residence to Spain and benefiting from the special regime of the so-called “Beckham Law”, as they will have to apply for other types of visa to be able to reside in our country and thus be able to apply the tax benefits of the aforementioned regime. One group particularly affected by this measure is that of individuals who, following the elimination of the UK’s ‘Non-dom’ regime, are looking for alternatives to relocate to countries where they can enjoy beneficial taxation.
